Internet Web Site User AGREEMENT IN PRINCIPLE Confidentiality By entering this site I demonstrate my acceptance of the following conditions. I fully understand that I have signed up to a membership agreement, which permits me to obtain imagery from Just Models Australia for a fee. I agree that I must purchase credits on account and that those credits will be used as I view images within the Just Models Australia pay per view areas of the World Wide Web. I agree that this is a contracted arrangement with Just Models Australia, and shall remain completely confidential. I agree that any and all business arrangements and or transactions related to Just Models Australia is confidential and is not open to discussion or conversation, comment or statement, either privately or publicly, of any description with any person or any party other than a representative of Just Models Australia. I also agree that all Just Models Australia documentation, printed, written, electronic, imaged, and in any other form, the content thereof and any or all access thereto, and Just Models Australia related material is provided to me as a professional courtesy and therefore remains completely confidential by every definition, understanding, implied and intended meaning of the term ‘confidential’. I therefore agree that I have not previously and I will not now or in the future copy, re-use, sell, give away, or provide in any form, or by any means, Just Models Australia material to another. Copyright and Media Release Any and all photographic imagery obtained by any electronic means, or any other means, of any model contracted to Just Models Australia; remains the sole property of Just Models Australia; without exception. This includes any and all imagery of any model obtainable from the Just Models Australia web pages or by any other means. Just Models Australia retains full ownership of all imagery of any contracted model for the indiscriminate, unlimited and exclusive use thereof, without exception and therefore all rights of imagery use are reserved. Therefore, editing, alteration, posing, positioning, marketing, publishing, publication, copy and public media release are totally prohibited without exception, and as such; all imagery copyright remains the property of Just Models Australia without exception. That payment of fees for the purpose of down loading does not provide the user with any rights of ownership or usage. All rights reserved. I accept and agree that my use of lawfully accessed imagery, electronic or otherwise; may at no time compromise the integrity of Just Models Australia and must not in any way bring Just Models Australia into disrepute. I understand that if my activities or actions are deemed to be inappropriate and therefore in breach hereof, my contract or agreement with Just Models Australia for access to Pay-per-view imagery may be terminated at the discretion of Just Models Australia. I also agree that the access provided to me by Just Models Australia to the Pay-Per-View Just Model Australia pages of the World Wide Web is by secure measures for my use only. I agree that I will not provide my access details to another for any reason. I agree that access authority to any imagery, paid for or not is a matter of confidentiality and I am granted no authorisation by Just Models Australia to provide same to another. I agree that to do so would constitute a serious breech of this agreement. Disclaimer JMA and its registered, owners, directors and management will not be responsible or liable for any infringement of any law in any locality interred into by any model, any persons associated therewith, any apparatus or prop, any property, any locality access, any act, any action or any activity; any signage, any trademark or name, for or involving the use of JMA imagery, in any form. JMA and its registered, owners, directors and management will not be responsible or liable for any personal act, action or activity of an offender or any persons associated therewith. JMA will not knowingly post, promote, advertise, market or publish in any form: any imagery, which violates or infringes any known relevant law. JMA will not be liable or responsible for the miss use or abuse of any imagery accessed from the JMA web site or pages of the World Wide Web by others. JMA will not be liable or responsible for actions or activities of models outside of directly solicited activities and actions on behalf of JMA by an appointed representative. Disclosure JMA provides this web site as a service to JMA clientele by individual agreement. It is not associated or affiliated with any other business, company or identity of any description and accepts no liability for any unauthorised use thereof. The imagery provided in Pay-per-view pages is to be used for instant viewing purposes only and is not for sale. Any unauthorised copy, reprint, reuse or republication is prohibited and punishable but law. Breach of the intended use of this material will cost the offending party all equitable damages allowable by law and will also incur an instant $10,000 Administration fee payable to JMA immediately, and recoverable from or by any source of credit card or bank account the user has provide details of for initial access to the subject material. It shall also be a debt to JMA recoverable by any lawful means. I have read the entire Conditions of Use Agreement. I fully understand and am in complete agreement with all of the conditions, stipulations and financial obligations set out therein. By my acceptance I give my consent to be held accountable hereto. Terms and Conditions The term of this agreement is 12 (twelve) calendar months - equivalent to 1 (one) calendar year. This agreement is renewable at the end thereof at the discretion of JMA. I agree that membership is free and involves no cost to me. However I agree that I will pay for credits with which to obtain use age of imagery on the pay per view areas of the JMA site. I agree that as the credits run out JMA will automatically refill the account by accepting immediate payment to do so from the credit facility provided by me for that purpose. I also agree that I will pay thereby the fee nominated by JMA for the imagery I access therein. I also agree to pay all required fees for registration of use of the privilege viewing pleasure of the material and imagery in the Pay-per-view pages of the JMA Web site. I agree that I will not alter or attempt to alter any set up, design or layout of the JMA pages on the WWW. I agree that I will undertake no action or activity, directly or indirectly to intentionally or unintentionally, with or without assistance, neither alone or in company with another: that could damage, hurt, reduce, diminish, destruct or cost JMA to suffer any loss whatsoever. I understand, agree and accept that in any circumstance in which I breach this agreement, I will be immediately liable and indebted to JMA for $10,000 administration fee payable immediately to JMA and that I will also be liable for all legal costs, actual loss, future loss directly or indirectly, and all ongoing costs to JMA arising from my actions or activities. I also agree that I may cancel this agreement with 7 (seven) days of sign up and therein I will forfeit my signup fee and all prepaid monthly hosting and management fees. I also agree that I may cancel this agreement after seven days from sign up and therein I will be immediately liable and indebted for $5000 cancellation fee payable immediately to JMA for compensation of prospected loss. I also agree and understand that any and all debt I have incurred to JMA may be withdrawn or accessed from payments owed to me from Pay-per-view imagery, credit card or bank accounts, the details of which I have provided to JMA at any previous time for any reason. I agree that the debt may be recovered from me in single deductions from those sources or in sectional deductions as payable from those accounts without further permission or notification to me. I also agree and accept that should I fail to make immediate payment for any and or all debt upon request from JMA I may face legal action for which I will pay all costs. I have read and understand the preceding terms and conditions and agree to abide thereby without dispute.
